Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Treadmill Workout mobile application ("the app"), operated by Mykola Androsovych, an individual entrepreneur registered in Ukraine ("we", "our", or "us"), available on Google Play and the Apple App Store. By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Eligibility

You must be at least 13 years old to use the app. By using the app, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. The app is not directed at children under 13.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, solely for your personal, non-commercial use, subject to these Terms and the rules of the app store from which you obtained the app.

3. Health and Safety Disclaimer

The app is not a medical device and does not provide medical advice. Treadmill Workout is a fitness planning and tracking tool intended for general informational and motivational purposes only.

Consult a qualified physician before beginning any exercise program, especially if you have a heart condition, are pregnant, are recovering from injury, or have any health concern.
Calorie, MET, heart-rate, distance, and elevation figures are estimates calculated from formulas (e.g., ACSM) and the data you enter. They may differ significantly from your actual values and should not be relied upon for medical, dietary, or clinical decisions.
Stop exercising immediately and seek medical attention if you feel pain, dizziness, shortness of breath, or any other symptom of distress.
You are solely responsible for exercising within your own physical limits.

4. Treadmill Connectivity and Hardware Control

Treadmill Workout is an independent application and is not affiliated with, endorsed by, sponsored by, or in any way associated with any treadmill manufacturer, fitness equipment brand, or subscription fitness service (including but not limited to NordicTrack, iFit, Peloton, Bowflex, ProForm, or any other brand). All product names and trademarks are the property of their respective owners.

The app can connect to compatible treadmills over Bluetooth (BLE) and may send commands that change belt speed and incline, and may start or stop the belt. By enabling this feature you acknowledge and accept the following:

You are responsible for the safe setup and operation of your treadmill at all times, including keeping the physical emergency stop / safety key within reach.
Never rely solely on the app to stop the treadmill. Connections may drop, commands may be delayed, and a device may lose focus or battery.
Ensure the area around the treadmill is clear and that you can safely react to speed or incline changes the app initiates.
Do not use the connectivity feature unattended, near children, or while distracted.
We are not the manufacturer of your treadmill. Use of this feature is at your own risk and may not be supported by, and may affect the warranty of, your treadmill manufacturer.

5. Subscriptions, Trial, and Payments

Free trial: new users may receive a time-limited trial with full features. When the trial ends, the app reverts to the Free tier unless you subscribe.
Free tier: includes core functionality and displays advertisements, with certain limits (e.g., on saved presets, history, and graphs).
Pro subscription: unlocks all features and removes ads. Pro is offered as a recurring subscription (monthly or yearly) or a one-time lifetime purchase.
Cloud history backup: how long your synced workout history is retained in our cloud backup depends on your plan (Free, subscription, or lifetime); your full history always stays on your device. See our Privacy Policy for details.
Billing: all purchases are processed by Google Play or the Apple App Store. We do not receive or store your payment details.
Auto-renewal: recurring subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends. Manage or cancel subscriptions in your Google Play or App Store account settings.
Refunds: refunds are handled according to the policies of the app store through which you purchased. We do not process payments directly and cannot issue refunds ourselves.
Price changes: we may change subscription prices; changes apply to future billing periods and, where required, with prior notice and your consent.

6. Acceptable Use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law;
Use the app for any unlawful purpose or in violation of these Terms;
Interfere with, disrupt, or attempt to gain unauthorized access to the app, our servers, or related services;
Resell, sublicense, or commercially exploit the app or its content without our written permission.

7. Intellectual Property

The app, including its code, design, text, graphics, and logos, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you. Workout data and configurations you create remain yours.

8. Third-Party Services

The app integrates third-party services (such as Google AdMob, Firebase, Google Play Billing, and Apple StoreKit). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services. See our Privacy Policy for details on data handling.

9. Disclaimer of Warranties

The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that calculated metrics will be accurate.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the app, including any injury or harm resulting from exercise or treadmill operation. To the extent liability cannot be excluded, it is limited to the amount you paid for the app in the 12 months preceding the claim, or USD 50, whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Termination

You may stop using the app at any time and uninstall it. We may suspend or terminate your access if you violate these Terms or if we discontinue the app. Sections that by their nature should survive termination (including Sections 7, 9, 10, and 12) will survive.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-law provisions, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory consumer rights you may have.
